WHEREFORE , the Court GRANTS the petition, SETS ASIDE the decision of the Court of Appeals in CA-G.R. SP 101903 dated April 24, 2008, and REINSTATES the decision of the National Labor Relations Commission in NLRC-NCR-CA 051703-07(7) dated August 31, 2007, which affirmed the decision of the Labor Arbiter in NLRC-NCR Case 07-05764-06. SO ORDERED.
