WHEREFORE , premises considered, the instant Petition is GRANTED . The challenged resolution of the NLRC dated 30 January 2009 is hereby REVERSED and SET ASIDE . Accordingly, the Decision of the NLRC dated 29 November 2007 is hereby REINSTATED . SO ORDERED.
