WHEREFORE , the Court GRANTS the petition, SETS ASIDE the Decision of the Court of Appeals in CA-G.R. SP 94309 dated September 26, 2007, and REINSTATES the Resolution of the National Labor Relations Commission in NLRC NCR 00-01-00205-03 dated December 29, 2005. SO ORDERED.
