Ruling

WHEREFORE, the court hereby finds the accused HECTOR ESTARES guilty beyond reasonable doubt of the crime of RAPE defined and penalized under paragraph 2, Article 335 of the Revised Penal Code, and hereby sentences the said accused to suffer the penalty of RECLUSION PERPETUA and to indemnify the offended party , Tessie Gange, the sum of P30,000.00 as moral and exemplary damages, without subsidiary imprisonment in case of insolvency, together with the accessory penalties provided for by law and to pay the costs. SO ORDERED.
