WHEREFORE , the Court AFFIRMS the appealed decision of the Regional Trial Court, Branch 7, Baganga, Davao Oriental in Criminal Case No. 899 finding accused Arteche Antonio y Payagan guilty beyond reasonable doubt of rape, defined and penalized under Article 335 of the Revised Penal Code, committed against Arnie Antonio and sentencing him to reclusion perpetua , with the MODIFICATION that he shall pay the victim, Arnie Antonio, the amount of fifty thousand (P50,000.

WHEREFORE , the Court AFFIRMS the appealed decision of the Regional Trial Court, Branch 7, Baganga, Davao Oriental in Criminal Case No. 899 finding accused Arteche Antonio y Payagan guilty beyond reasonable doubt of rape, defined and penalized under Article 335 of the Revised Penal Code, committed against Arnie Antonio and sentencing him to reclusion perpetua , with the MODIFICATION that he shall pay the victim, Arnie Antonio, the amount of fifty thousand (P50,000.00) pesos as civil indemnity in addition to the fifty thousand (P50,000.00) pesos as moral damages. With costs. SO ORDERED.
