WHEREFORE, premises considered, judgment is hereby rendered finding the accused Severino Antonio GUILTY beyond reasonable doubt of the crime of murder, defined and penalized under Art. 248 of the Revised Penal Code. There being neither mitigating nor aggravating circumstance, and applying the provisions of the Indeterminate Sentence Law, said accused is hereby sentenced to a prison term ranging from TWELVE (12) YEARS of prision mayor, as minimum, to SEVENTEEN (17) YEARS, FOUR (4) MONTHS, and ONE (1) DAY of reclusion temporal, as maximum, together with all the accessory penalties thereof. He is also ordered to pay the heirs of GONZALO GUTIERREZ the sum of THIRTY THOUSAND ( P 30,000.00 ) PESOS as indemnification for the latters death. Cost against the accused. SO ORDERED.
