WHEREFORE, in view of the foregoing, DECISION is hereby rendered , finding the accused, Gerry Cirilo, GUILTY, beyond reasonable doubt, of the crime, of Murder, as charged, in the aforequoted information. Considering that at the time of the commission of the offense, the death penalty has been abolished by the Cory Constitution, and not yet reinstated by the legislative, the aforenamed accused, is hereby sentenced, to suffer indeterminate penalty of imprisonment, ranging from 14 years, 8 months, …
WHEREFORE, in view of the foregoing, DECISION is hereby rendered , finding the accused, Gerry Cirilo, GUILTY, beyond reasonable doubt, of the crime, of Murder, as charged, in the aforequoted information. Considering that at the time of the commission of the offense, the death penalty has been abolished by the Cory Constitution, and not yet reinstated by the legislative, the aforenamed accused, is hereby sentenced, to suffer indeterminate penalty of imprisonment, ranging from 14 years, 8 months, and one day, as minimum, to 17 years, 4 months and 1 day, Reclusion Temporal , as maximum, to indemnify the heirs of the late Efren Dableo, in the amount of P50,000.00 and to pay the cost. SO ORDERED.
