WHEREFORE, the Court finds accused JAIME BALACANO y DALAFU GUILTY beyond reasonable doubt as principal of the crime of Rape, defined and penalized under Article 335 of the Revised Penal Code, as amended by Section 11 of Republic Act No. 7659, and is hereby sentenced to suffer the penalty of DEATH in Criminal Case No. Q-95-62686. The accused is likewise ordered to indemnify the victim Esmeralda Balacano the amount of One Hundred Thousand (P100,000.
