WHEREFORE, the Decision of the court a quo finding the accused FILOMENO AVERGONZADO alias Minoc guilty of rape is AFFIRMED with the modification that the penalty is reduced from death to reclusion perpetua . The accused is ordered to pay the victim P50,000.00 as civil indemnity in addition to the P50,000.00 already awarded by the court a quo as moral damages.
