WHEREFORE, in view of the foregoing, the Court finds the accused ARGIE AVETRIA, GUILTY beyond reasonable doubt of the crime of Violation of Section 10 of [Republic Act No.] 7610 and hereby sentences him to suffer the indeterminate penalty of five (5) years, four (4) months and twenty-one (21) days of prision correccional as minimum, to six (6) years, eight (8) months and one (1) day of prision mayor as maximum. The Court also ordered him to pay the amount of [PHP] 50,000.
WHEREFORE, in view of the foregoing, the Court finds the accused ARGIE AVETRIA, GUILTY beyond reasonable doubt of the crime of Violation of Section 10 of [Republic Act No.] 7610 and hereby sentences him to suffer the indeterminate penalty of five (5) years, four (4) months and twenty-one (21) days of prision correccional as minimum, to six (6) years, eight (8) months and one (1) day of prision mayor as maximum. The Court also ordered him to pay the amount of [PHP] 50,000.00 as civil indemnity, [PHP] 50,000.00 as moral damages, and [PHP] 50,000.00 as exemplary damages plus interest of six (6) percent per annum until fully paid. The Plaridel Surety and Insurance Company is hereby released from its further undertaking. SO ORDERED.
