Accordingly, it rendered its Judgment [29] on 25 February 1999, and decreed as follows: WHEREFORE, premises considered, this Court finds the accused Alejandre delos Santos y Renigado GUILTY beyond reasonable doubt of the crime of RAPE, defined and penalized under Article 335 of the Revised Penal Code, as amended by Republic Act 7659 and hereby sentences the said accused to suffer the penalty of DEATH and to pay the victim the sum of P50,000.00 by way of moral damages and to pay the costs. SO ORDERED.
