WHEREFORE, in view of all the foregoing considerations, the Court finds both above-named accused, Alex Casemiro and Jose Catalan, Jr., Guilty beyond reasonable doubt of the crime of Murder, qualified by treachery and abuse of superior strength, and sentences each accused Alex Casemiro and Jose Catalan, Jr., a penalty of Reclusion Perpetua and to pay the actual damages to the heirs of victim Jeffrey Hermo in the amount of FIFTY THOUSAND PESOS (Php50,000.
WHEREFORE, in view of all the foregoing considerations, the Court finds both above-named accused, Alex Casemiro and Jose Catalan, Jr., Guilty beyond reasonable doubt of the crime of Murder, qualified by treachery and abuse of superior strength, and sentences each accused Alex Casemiro and Jose Catalan, Jr., a penalty of Reclusion Perpetua and to pay the actual damages to the heirs of victim Jeffrey Hermo in the amount of FIFTY THOUSAND PESOS (Php50,000.00) and moral damages in the amount of TWENTY THOUSAND PESOS (Php20,000.00) The period of their provisional detention is deducted in full of the aforesaid penalty of Reclusion Perpetua if they abide with the rules and regulations of a convicted prisoner, otherwise only 4/5 shall be credited. SO ORDERED.
