Ruling

WHEREFORE , premises considered and taking into account the qualifying circumstance of Treachery and the generic aggravating circumstance of use of superior strength, the court finds the accused Pepito Orbita, Ceferino Capisunda and Orlando Santiago GUILTY BEYOND REASONABLE DOUBT of the crime of MURDER and are hereby sentenced to suffer the penalty of RECLUSION PERPETUA together with all the accessory penalties, to jointly and solidarily indemnify the heirs of the victim in the amount of FIFTY THOUSAND (50,000.00) PESOS and to pay the costs of suit. SO ORDERED.
