WHEREFORE, premises considered, the appeal is hereby GRANTED and the assailed Order dated October 24, 2002 issued by the Regional Trial Court (RTC) of Gapan, Nueva Ecija, Branch 87, is REVERSED and SET ASIDE. Accordingly, the subject complaint is reinstated and the records of the case is (sic) hereby remanded to the RTC for further proceedings. SO ORDERED.
