Ruling

WHEREFORE , the appeal is DENIED . The Decision dated June 29, 2018 of the Court of Appeals in CA-G.R. CR-HC No. 09423 that found accused-appellant XYZ guilty beyond reasonable doubt of Rape defined and penalized under Articles 266-A and 266-B of the Revised Penal Code, as amended by Republic Act No. 8353, is AFFIRMED . Accused-appellant XYZ is sentenced to suffer the penalty of reclusion perpetua and is hereby ORDERED to pay AAA the following amounts: P75,000.00 as civil indemnity, P75,000.00 as moral damages, and P75,000.00 as exemplary damages. All the damages awarded shall earn interest at the legal rate of 6% per annum from the finality of this judgment until fully paid. SO ORDERED.
