WHEREFORE, the assailed Decision of the Court of Appeals dated November 26, 2001 is hereby MODIFIED . The Civil Service Commission is declared with legal standing to file its appeal and/or motion for reconsideration in this case. But we hereby sustain the decision of the Court of Appeals insofar as it declares that Jocelyn S. Gentallan should be reinstated to her position with backwages, RATA, and bonuses to be paid by the Municipality of Jasaan, Misamis Oriental.
