WHEREFORE, the instant petition is GRANTED. The Decision dated March 13, 2001 and the Resolution dated March 13, 2002 of the Court of Appeals in CA-G.R. SP No. 54612 are REVERSED . The Resolution No. 990299 dated January 29, 1999 and Resolution No. 991572 dated July 13, 1999 are SET ASIDE. Let Derick D. Wooden's PBET eligibility be REINSTATED and his REINSTATEMENT to the position of Teacher I of Guinzadan National High School, Bauko, Mountain Province is ORDERED with backwages for five years from the time he was dismissed on January 29, 1999. SO ORDERED.
