WHEREFORE , the Decision of the Regional Trial Court, Br. 46, San Jose, Occidental Mindoro, in Crim. Case No. R-4328 finding APOLONIO ACOSTA guilty of RAPE is AFFIRMED with the MODIFICATION that his death sentence is reduced to reclusion perpetua .

WHEREFORE , the Decision of the Regional Trial Court, Br. 46, San Jose, Occidental Mindoro, in Crim. Case No. R-4328 finding APOLONIO ACOSTA guilty of RAPE is AFFIRMED with the MODIFICATION that his death sentence is reduced to reclusion perpetua . The order requiring him to pay the victim Maritess Acosta the sums of P50,000.00 for civil indemnity and another P50,000.00 for moral damages is AFFIRMED. SO ORDERED.
