WHEREFORE , the Court GRANTS the petition, REVERSES and SETS ASIDE the decision dated October 13, 2008 of the Court of Appeals in CA-G.R. SP 103470, and REINSTATES the October 10, 2007 decision of the Regional Trial Court in Civil Case 07-0111, which dismissed the complaint for quo warranto . SO ORDERED.
