WHEREFORE , the petition is GRANTED . The Resolutions of the Court of Appeals dated October 20, 2005 and June 28, 2006 are REVERSED and SET ASIDE . The court of origin, Branch 48 of the Regional Trial Court of Urdaneta, Pangasinan, is ORDERED to reinstate Civil Case No. U-7952 to its docket and take action thereon with dispatch.
