WHEREFORE, as the evidence has conclusively established that Jennifer Platilla was below 18 years old, being only 13, at the time she was raped by her own father Nicomedes Platilla, the court finds accused NICOMEDES PLATILLA guilty beyond reasonable doubt of the crime of rape penalized under Article 335 of the Revised Penal Code, as amended by R.A. 7659, as principal thereof, and hereby sentences him to suffer the supreme mandatory penalty of death, to indemnify Jennifer Platilla P50,000.
