Ruling

WHEREFORE , premises considered, the Court hereby AFFIRMS the appealed decision convicting the appellant, Simeon B. Cruz, a.k.a. Barok, of three (3) counts of rape with the MODIFICATION that the appellant shall suffer the penalty of reclusion perpetua and to indemnify the victim, herein private complainant Vanessa S. Cruz, in the amount of P50,000.00 as civil indemnity in addition to P50,000.00 as moral damages for each count of the offense proved. SO ORDERED.
