TL;DR — Ruling

WHEREFORE , the judgment finding Antonio Pedres y Buag guilty beyond reasonable doubt of the crime of rape is AFFIRMED with the modification that the penalty imposed is reclusion perpetua . The appellant is ordered to pay the victim the amount of P50,000.00 as civil indemnity and P50,000.00 as moral damages.

accordingly constrained to modify the penalty imposed by the trial court from death to reclusion perpetua . Relative to the monetary liability of the accused we find the award of P50,000.00 by way of indemnity ex delicto and another P50,000.00 as moral damages to be in order. WHEREFORE , the judgment finding Antonio Pedres y Buag guilty beyond reasonable doubt of the crime of rape is AFFIRMED with the modification that the penalty imposed is reclusion perpetua . The appellant is ordered to pay the victim the amount of P50,000.00 as civil indemnity and P50,000.00 as moral damages. SO ORDERED.
