WHEREFORE, respondent MURIEL S. SAN JOSE, Sheriff III, Municipal Trial Court in Cities, Branch 1, Naga City, is found GUILTY of gross neglect in the performance of his duties. In view of his previous dismissal, he is now FINED P5,000.00 and all his benefits, except accrued leave credits, if any, are forfeited, with prejudice to re-employment in any branch or instrumentality of the government, including government-owned and controlled corporations and financial institutions.
