Ruling

WHEREFORE , the appealed Decision of the Regional Trial Court, Br. 40, of Palayan City in Crim. Case No. 0534 - P is REVERSED and SET ASIDE . Accused-appellant Bonifacio Baltazar is ACQUITTED on insufficiency of evidence or on reasonable doubt. The Director of Prisons is DIRECTED to forthwith cause the release of Bonifacio Baltazar unless the latter is held for another lawful cause and to inform this Court accordingly within ten (10) days on the action taken hereon. SO ORDERED.
