WHEREFORE , for failure of the prosecution to prove the guilt of appellant beyond reasonable doubt, the decision of the Regional Trial Court, Branch 42, Pinarnalayan, Oriental Mindoro in Criminal Case No. P-5586 is REVERSED and SET ASIDE. Appellant Nestor Coderes y Ablaza is ACQUITTED and his immediate RELEASE from confinement is ordered, unless some other lawful cause warrants his further detention. The Director of Prisons is DIRECTED to inform this Court immediately of the action taken hereon within five (5) days from receipt hereof Costs de oficio. SO ORDERED.
