WHEREFORE, this court finds the accused LEOSANDRO MELAYO y LUHA GUILTY beyond reasonable doubt of the crime of theft with the aggravating circumstance of being committed on the occasion of a conflagration and pursuant to law hereby sentences him to suffer the indeterminate prison term of six (6) years of prision correccional as minimum to twelve (12) years of prision mayor as maximum, and to pay the costs.

WHEREFORE, this court finds the accused LEOSANDRO MELAYO y LUHA GUILTY beyond reasonable doubt of the crime of theft with the aggravating circumstance of being committed on the occasion of a conflagration and pursuant to law hereby sentences him to suffer the indeterminate prison term of six (6) years of prision correccional as minimum to twelve (12) years of prision mayor as maximum, and to pay the costs. Further, the accused is ordered to pay complainant Theresa Mina actual damages in the sum of P 19,000.00 representing the value of the stolen articles with interests thereon at the legal rate from the date of the filing of this case, i.e. , July 11, 1994, until fully paid. SO ORDERED.
