WHEREFORE , the petition is DENIED . The assailed Decision of the CA dated September 11, 2009 and the Resolution dated November 24, 2009 are AFFIRMED with the MODIFICATION that respondent should return the amount of P55,620.60 with the legal interest computed at the rate of 6% per annum reckoned from July 7, 1997 until finality of this judgment. Thereafter, the total amount shall earn interest at the rate of 6% per annum from the finality of this judgment until its full satisfaction.
