Ruling

WHEREFORE, judgment is rendered convicting the accused of Rape with Homicide as defined and punished under Article 335 of the Revised Penal Code, as amended, and this Court sentences the accused June Rex Paburada: 1) to suffer the penalty of imprisonment of reclusion perpetua and its accessory penalties; 2) and to indemnify the heirs of Rosemarie Andrade the total sum of One Hundred Sixty-Four Thousand, Four Hundred Pesos (P164,400.00), and to pay the costs. "Being a detention prisoner, the accused is entitled to the benefits of Article 29 of the Revised Penal Code, as amended. "SO ORDERED.
