Ruling

WHEREFORE, finding accused Alejandro Padua y Cabalquento @ Andoy Padua, Christopher Padua y Videna @ Popop Padua and Michael Dullavin y Valencia @ Mike or Meke guilty of the crime of rape with homicide, the Court hereby sentences each of them to suffer the penalty of death, to pay the heirs of XXX the following sums: P100,000.00 as civil indemnity, P30,000.00 for the wake, burial, coffin of XXX, and P50,000.00 as moral damages. Costs against the accused. However, pursuant to Article 83 of the Revised Penal Code, as amended, the death sentence shall not be inflicted upon accused Alejandro Padua who is over 70 years of age and the same shall be commuted to the penalty of reclusion perpetua with the accessory penalty provided for in Article 40. SO ORDERED.
