WHEREFORE, in view of the foregoing, the Court finds accused RESTBEI BASAK TAMPUS guilty beyond reasonable doubt of Violation of Section 5, Article II of RA 9165 and is hereby sentenced to suffer the penalty of life imprisonment and a fine of three (3) million pesos. The subject one big plastic pack of shabu is forfeited in favor of the government. SO ORDERED.
