WHEREFORE, premises considered[,] the court finds accused Elmer Padua y Garin guilty beyond reasonable doubt of Rape by Sexual Assault under Art. 266-A par. 2 of the Revised Penal Code and imposes upon him the indeterminate penalty of Twelve (12) years, Ten (10) months and Twenty-One (21) days of reclusion temporal as minimum[,] to Fifteen (15) years, Six (6) months and Twenty (20) days of reclusion temporal , as maximum.

Accused is further ordered to pay AAA or her successors-in-interest civil indemnity in the amount of Php. 30,000.00, and moral damages in the amount of [PHP] 30,000.00 both of which shall earn interest at the rate of six percent (6%) per annum from the date of finality of this decision until fully paid. SO ORDERED.
