WHEREFORE, premises considered, this Court is of the opinion and so holds that indeed the private complainant has established and proven the guilt of the accused beyond reasonable doubt. WHEREFORE, premises considered, this Court is of the opinion and so holds that indeed the private complainant has established and proven the guilt of the accused beyond reasonable doubt. Having found the accused guilty beyond reasonable doubt of the crime of rape, and there being only one mitigating circumstance of voluntary surrender and the crime having been committed prior to the amendment of the law on rape, the accused is hereby sentenced to suffer the imprisonment ( sic ) of reclusion perpetua . Accused is further ordered to indemnify the victim the sum of P50,000.00 as damages. SO ORDERED.
