Ruling

WHEREFORE , the Decision of the Court of Appeals Cebu City in CA-G.R. CR-HC No. 00035 is AFFIRMED with MODIFICATION . Appellants Ricardo Dearo and Wilfredo Toledo are hereby SENTENCED to suffer the penalty of reclusion perpetua without eligibility for parole for each of the three counts of murder, and ORDERED to pay the heirs of each of the victims Emeterio Santiago, Porferia Luague Guardario and Analiza Guardario the amounts of P75,000 as. civil indemnity, P75,000 as moral damages, P30,000 as exemplary damages, and P25,000 as temperate damages, plus the legal interest at the rate of 6% from the finality of this Decision until fully paid. SO ORDERED.
