WHEREFORE , the instant appeal is DENIED . The Decision of the Court of Appeals in CA-G.R. CR H.C No. 02544 which affirmed in toto the Decision of the Regional Trial Court of Pasig City, Branch 267 convicting Loreto C. Daria, Jr. "alias" Tayap of violation of Section 5, Article II of Republic Act No. 9165, sentencing him to suffer the penalty of life imprisonment, and imposing upon him a fine of P500,000.00, and, for violation of Section 11, Article II, Republic Act No. 9165, imposing upon him the indeterminate penalty of imprisonment ranging from 12 years and 1 day to 14 years and a fine of P300,000.00, is AFFIRMED in toto . SO ORDERED.
