WHEREFORE, the Decision appealed from finding accused-appellant DANILO CAPITLE alias Danny guilty beyond reasonable doubt of murder and sentencing him to reclusion perpetua and ordering him to pay the heirs of the victim Yubegildo Peralta P50,000.00 as death indemnity and P7,581.00 as actual damages is AFFIRMED, with the MODIFICATION that accused-appellant is further ordered to compensate the heirs with P50,000.00 as moral damages for their mental and emotional anguish. Costs against accused-appellant. SO ORDERED.
