TL;DR — Ruling

WHEREFORE, the Decision of the trial court convicting the accused ELMEDIO CAJARA alias Elming of Qualified Rape is MODIFIED to the effect that he is convicted instead only of Simple Rape and is sentenced to suffer the penalty of reclusion perpetua. He is further ordered to pay the victim Marita B. Cajote civil indemnity of P50,000.00 and moral damages of another P50,000.
