WHEREFORE, the foregoing considered, the assailed decision finding accused-appellant guilty of qualified rape is MODIFIED in that accused-appellant Dalisay is instead found guilty beyond reasonable doubt of SIMPLE RAPE and is sentenced to suffer the penalty of reclusion perpetua . The award of damages by the court a quo is affirmed. SO ORDERED.
