WHEREFORE, the assailed decision of the Regional Trial Court of Digos, Davao del Sur, is hereby MODIFIED. Appellant Jose Geral is declared GUILTY beyond reasonable doubt only of the crime of homicide and sentenced to suffer a prison term of 10 years of prision mayor, as minimum, to 17 years and 4 months of reclusion temporal, as maximum, and to pay the heirs of the victim, Ciriaco Lanticse, Jr., P50,000.00 as civil indemnity, as well as the costs.
