WHEREFORE, the appealed Decision is MODIFIED . Accused-appellant RODEL DIZON Y ABILA is instead declared GUILTY of homicide and sentenced accordingly to an indeterminate prison term of eight (8) years, six (6) months and twenty (20) days of prision mayor medium as minimum, to twelve (12) years, four (4) months and ten (10) days of reclusion temporal minimum as maximum. Accused-appellant is further ordered to indemnify the heirs of Juanito Baful in the amount of P50,000.
WHEREFORE, the appealed Decision is MODIFIED . Accused-appellant RODEL DIZON Y ABILA is instead declared GUILTY of homicide and sentenced accordingly to an indeterminate prison term of eight (8) years, six (6) months and twenty (20) days of prision mayor medium as minimum, to twelve (12) years, four (4) months and ten (10) days of reclusion temporal minimum as maximum. Accused-appellant is further ordered to indemnify the heirs of Juanito Baful in the amount of P50,000.00 for his death, and another P50,000.00 for moral damages, without subsidiary imprisonment in case of insolvency. SO ORDERED.
