Ruling

WHEREFORE , premises considered, the Court finds accused ARJAY [GUTIERREZ] y CONSUELO alias "RJ" GUILTY beyond reasonable doubt of violation of Section 11, Article II of RA No. 9165, and hereby sentences him to suffer imprisonment from twelve (12) years and one (1) day to fourteen (14) years and eight (8) months, and a fine of three hundred thousand pesos (P300,000.00). The 0.90 gram of dried marijuana fruiting tops (Exhibits "K" to "Q") subject matter of the instant case is forfeited in favor of the government, and its transmittal to the Dangerous Board for its immediate destruction is hereby ordered. SO ORDERED.
