WHEREFORE , this Court hereby finds accused RICARDO TAYAMEN, JR. and CARMELITA TAYAMEN GUILTY beyond reasonable doubt of the crime of Estafa penalized under Article 316 (2) of the Revised Penal Code and hereby sentences them to serve the penalty of imprisonment of [two (2)] months and one (1) day to three (3) months of arresto mayor in its minimum and medium periods and for each accused to pay the FINE of Eight Hundred Thousand Pesos (Php800,000.
WHEREFORE , this Court hereby finds accused RICARDO TAYAMEN, JR. and CARMELITA TAYAMEN GUILTY beyond reasonable doubt of the crime of Estafa penalized under Article 316 (2) of the Revised Penal Code and hereby sentences them to serve the penalty of imprisonment of [two (2)] months and one (1) day to three (3) months of arresto mayor in its minimum and medium periods and for each accused to pay the FINE of Eight Hundred Thousand Pesos (Php800,000.00), with subsidiary imprisonment in case of insolvency or failure to pay the fine. The accused are further ordered to jointly and severally pay private complainant Ma. Mildred G. Bangit the amount of Eight Hundred Thousand Pesos (Php800,000.00) representing the consideration for the sale. SO ORDERED.
