Ruling

WHEREFORE , the appeal is GRANTED . The September 27, 2013 Decision of the Court of Appeals in CA-G.R. CR-HC No. 05707 is REVERSED and SET ASIDE . The accused-appellants, Ramil Doria Dahil and Rommel Castro y Carlos, are ACQUITTED of the crime charged against them and ordered immediately RELEASED from custody, unless they are being held for some other lawful cause. The Director of the Bureau of Corrections is ORDERED to implement this decision and to inform this Court of the date of the actual release from confinement of the accused within five (5) days from receipt of copy. SO ORDERED.
