WHEREFORE, having weighed the evidence on both sides, the Court finds Eduardo Perez y Alavado GUILTY beyond reasonable doubt of the crime of RAPE, defined and penalized under Article 266-A of Republic Act No. 8353, The Anti-Rape Law of 1997, as principal and as charged, and in the absence of any aggravating or mitigating circumstance attendant in the commission of the offense, does hereby sentence him to suffer the penalty of RECLUSION PERPETUA, to indemnify the offended party the sum of P100,000.00, Philippine Currency, and to pay the costs. SO ORDERED.
