Ruling

WHEREFORE , premises considered, the Decision dated September 18, 2015 of the Court of Appeals, Sixth (6 th ) Division in CA-G.R. CR HC No. 06785 is REVERSED and SET ASIDE . Accused-appellant Oscar Gimpaya is hereby ACQUITTED for failure of the prosecution to prove his guilt beyond reasonable doubt. He is ordered immediately RELEASED from detention, unless he is confined for any other lawful cause. Let a copy of this Decision be furnished to the Director of the Bureau of Corrections, Muntinlupa City, for immediate implementation. The Director of the Bureau of Corrections is directed to report to this Court, within five (5) days from receipt of this Decision, the action he has taken. A copy of the Decision shall also be furnished to the Director General of the Philippine National Police for his information. SO ORDERED.
