WHEREFORE , the appeal is GRANTED . The February 22, 2017 Decision of the Court of Appeals in CA-G.R. CR-HC No. 07680 is hereby REVERSED and SET ASIDE for failure of the prosecution to prove beyond reasonable doubt the guilt of Raul Del Rosario y Niebres. He is hereby ACQUITTED of the crimes charged against him and ordered immediately RELEASED from custody, unless he is being held for some other lawful cause. The Director of the Bureau of Corrections is ORDERED to implement this Decision and to inform this Court of the date of the actual release from confinement of Raul Del Rosario y Niebres within five (5) days from receipt of this Decision. SO ORDERED.
