TL;DR — Ruling
WHEREFORE, the Decision of the Regional Trial Court, Br. 26, San Jose, Southern Leyte, finding accused Antonio Desuyo alias "Tony" guilty of "multiple rape" in its qualified form and ordering him to pay complaining witness Maricel Peru Desuyo P75,000.00 as civil indemnity, is MODIFIED . The accused is instead found guilty of two (2) counts of simple rape and, accordingly, sentences him to reclusion perpetua for each count.

The accused is instead found guilty of two (2) counts of simple rape and, accordingly, sentences him to reclusion perpetua for each count. In addition to paying Maricel Peru Desuyo civil indemnity in the amount of P50,000.00, instead of P75,000.00, for each count of rape, accused is further ordered to pay moral damages in the amount of P50,000.00 also for each count. Costs de oficio . SO ORDERED.
