WHEREFORE, the decision of the Court of Appeals in CA-G.R. CR-H.C. No. 01301 is AFFIRMED WITH MODIFICATION. Appellant is found GUILTY of only ONE count of simple rape and ACQUITTED of the TWO other counts of qualified rape. Appellant is sentenced to suffer the penalty reclusion perpetua , and ordered to pay to the victim P50,000.00 as civil indemnity, P50,000.00 as moral damages and P25,000.00 as exemplary damages. SO ORDERED.
