WHEREFORE, in view of all the foregoing, this Court hereby finds the accused HENRY DE GUZMAN y PASCUAL GUILTY beyond reasonable doubt of the crime of rape as charged in the Information, without any modifying circumstance and accordingly hereby sentences him to a penalty of reclusion perpetua with the accessory penalties provided for by law; to indemnify ROSARIO LIAN the amount of P50,000.00 by way of moral damages; and to pay the costs. SO ORDERED.
