WHEREFORE, premises considered, the Court finds that the guilt of the accused, Victor Bacor, has been proved beyond reasonable doubt, and pursuant to Article 248 of the Revised Penal Code, there being one mitigating circumstance of voluntary surrender without any aggravating circumstance to effect the [same], the said accused, Victor Bacor, is hereby sentenced to suffer an indeterminate penalty of imprisonment ranging from TEN (10) YEARS and ONE (1) DAY, of Prision Mayor, as minimum, to SEVENTEEN (17) YEARS, FOUR (4) MONTHS AND ONE (1) DAY of Reclusion Temporal, as maximum, to indemnify the heirs of the victim, Dionisio Albores in the amount of P50,000.00; to suffer the other accessory penalties provided for by law and to pay the costs of the proceedings. "The case with respect to the other accused, John Doe is hereby ordered sent to the archive, to be revived as soon as said accused is identified and arrested. "SO ORDERED.
